This Emerge Group Mastermind (“the program”) Special Agreement is made between Jin Ong (“the Coach”) of The Art Of Listening To Your Body Limited (“the Company”) and the client, (“You.”)
You agree to the following:
Commitment:
You are joining the Emerge Mastermind (the Program) because you want a mentor, supporter, and accountability partner as you move into the next phase of your business. By choosing to participate in this Program you are committing to the next 12 months of the Program, including the full financial investment.
You understand that by joining, you will maximize the value of your investment by attending live calls, use your coaching sessions (1 per month), and participating in the community forum. You are agreeing that we do not pause, put on hold, or cancel enrolment or monthly payments. You are committing to 12 consecutive months, enrolment & payments.
Coaching:
The service to be provided by the Coach is a group mastermind coaching program. Coaching – which is not therapy or counselling – may help you grow your business through professional and personal development which promotes continuous growth and strength.
All sessions must be used monthly, by then end of the program. Your coach will send one reminder on the group to book your call. If you cannot find an appropriate time it is your responsibility to contact the coach as soon as possible. Please do not leave your booking until the end of the month. We encourage you to turn up and be coached each month regardless of what is going on. Our coaches are intuitively lead and here to serve you no matter what. If you choose to not have a coaching session in a month this is up to you, however you understand that you have already committed as have our coaches. You may forfeit your coaching session at your own expense.
You understand that this program does not include 1:1 sessions with Jin. You do however have 1:1 access with our support coach(es). By signing this agreement, you are releasing the company of any liability.
If you wish to pursue 1:1 coaching with Jin this is separate to the Program and will be charged accordingly.
Program structure:
The Program runs for 12 months and includes 4 group zoom calls per month (2 with Jin and two with our support coaches). Dates & times will be sent to you separately and will also be posted in the private FB group in the “Guides” section. It is your responsibility to calendar all of the calls. Attending all calls live is highly recommended, though call recordings will always be provided. Call dates and times are subject to change due to the Coach's travel schedule or illness however we do our best to commit to the times scheduled.
Facebook group:
You will be added to a private Facebook group after your initial payment has been completed, and your agreement has been signed. The group is intended to be a supportive place to receive coaching and advice from the Coach, support coach(es) and Program participants. It is also where program information will be stored. Any hate language, chronic complaining or blaming will not be tolerated. You will receive a warning and if your behaviour is deemed to create an unsafe or disruptive environment for other participants, you will be removed from the group. You will not be entitled to any refund of your investment.
Content:
All content provided in the Program is the property of the Coach. You may not copy, download or store any content provided in the Program unless specified. Content is accessible only while you are an active member, and is not accessible after the program is complete. Content may not be shared with others outside of the Program. Content includes but is not limited to files, worksheets, PDFs, special trainings, Google Docs, group call recordings, etc.
Fee:
Your investment for Program is $18,888 USD paid in full.
Payment Plan Schedule:
$1, 888 USD to be billed immediately and $1, 888 USD per month for the following 11 months. Your credit card will be held on file for recurring billing.
PayPal fees: Should you choose to pay via PayPal, an additional $25 USD administration fee will be applied to all payments.
Late fees: A late fee of $50 USD/month will be assessed after a one time only 14 day grace period on the first late payment. All subsequent late payments will immediately be charged the $50 USD/month late payment fee. To avoid these fees, please inform us in writing via email of any changes to your address or credit card immediately.
GST
New Zealand based clients have the option of being charged in NZD and amounts will be inclusive of GST. If you are GST registered you may request an invoice to claim your GST.
Default of Payment:
“Default” shall mean the non-payment of sums due according to the terms of this Agreement. In the event of Default on your part, coaches may cease all further performance under this agreement and shall not be liable for any losses or damages suffered by you as a result of our cessation of services.
By signing this Agreement, you agree to be legally obligated to pay the full amount of this 12 month Program. Payments are not refundable for any reason. Payments are due regardless of whether or not you fully and faithfully participate.
I understand that there are no refunds available and should I decide to end my coaching with the Coach that all unused coaching has no cash value. In the event that this program is cancelled, applicable future monthly payments will also be cancelled, but no refunds for previous payments will be issued.
Program results:
You are fully responsible for your results in this program. While we are absolutely convinced that you will derive great benefits from this Program and that you should become as successful as you desire, We of course cannot guarantee that you will attain a certain level of clients, sales, or profit as a result of this Program. As with any small business, each owner’s success depends on many factors, including your personal motivation, time commitment, how effectively you implement the strategies taught, and your efficiency in following up on each phase. The cost of this Program is an “investment” in yourself as a business owner, and, as with any investment, there is both great potential for a great return on your investment, and a risk there is no return on this investment.
We can guarantee, however, that you WILL learn a lot of usable and applicable business strategies that, when followed by others, have achieved great results. The most successful participants in this program will attend all calls and workshops, and actively participate in the Facebook group, as both seeking and offering support.
Communications/media:
As part of my participation in this Program, I agree that the Coach may video record, audio record, photograph or otherwise capture my likeness, voice, images, interviews, and statements made, and hereby assign to the Coach all rights and title to have and to use within the coaching program and made available for other participants for learning purposes.
Governing Law:
This Agreement shall be construed in accordance with, and governed by, the laws of New Zealand as applied to contracts that are executed and performed entirely in New Zealand.
