The Moth Portal (“the Offer”) and mini-courses and masterclasses (the “Program(s)”) Special Agreement is made between The Art Of Listening To Your Body Limited (“the Company”), Jin the (“Coach”)and the client, (“You.”)
SERVICES
The Client will be provided access to programs as part of this offer.
Whilst a member the client will also receive invitations via email to join any live elements (ie present on zoom for the teaching or access live Q&A) offered alongside future programs as part of the offer.
The offer is hosted on the Kajabi platform. The Client will be given access to the programs as long as your membership remains active.
At times programs may be updated or removed if they are no longer aligned with the Company's ethos.
*Excludes signature live coaching courses such as Release, Emotional Body Training and any other ongoing group coaching offers and/or masterminds as well as 1:1 offers.
Content:
Content is accessible only while you are an active member, and is not accessible after cancellation of your membership. Content may not be shared with others outside of the Program. Content includes but is not limited to files, worksheets, PDFs, special trainings, Google Docs, group call recordings, etc.
As part of your participation in this Program, you agree that the Coach may video record, audio record, photograph or otherwise capture my likeness, voice, images, interviews, and statements made, and hereby assign to the Coach all rights and title to have and to use within the coaching program and made available for other participants (in your cohort) for learning purposes. This includes transcripts and zoom chat text.
Program results:
You are fully responsible for your results in this program. While we are absolutely convinced that you will derive great benefits from this Program and that you can become as successful as you desire, We of course cannot guarantee that you will attain a certain level of clients, sales, or profit as a result of this Program. Success depends on many factors, including your personal motivation, time commitment, how effectively you implement the strategies taught, and your efficiency in following up on each phase. The cost of this Program is an “investment” in yourself and, as with any investment, there is both great potential for a great return on your investment, and a risk there is no return on this investment.
We can guarantee, however, that you WILL learn a lot of usable and applicable strategies that, when followed by others, have achieved great results. The most successful participants in this program will attend all calls and workshops, and actively participate in the Facebook group, as both seeking and offering support.
Investment
Monthly membership.
$222 USD/month as long as you stay an active member your investment will not change for 12 months after which you will be asked if you would like to renew access to the Moth Portal at the current investment.
The investment will continue to increase as more Programs are added over time. The monthly investment will remain the same for a 12 month period from time of investing in the Offer
Monthly memberships are direct debited from The Client's provided credit card each month.
Payment is required in full to gain access to the Offer. The Client agrees to pay in full the amount due for their chosen period of investment. The Client authorises the Company to charge the card provided on a monthly basis.
The Client is responsible to ensure that payments go through smoothly on time, without delay. Any failed our bounced payments are followed up with an email from out system which allows time to ensure your credit card details are up to date. Our system will automatically retry taking payment. Please action this promptly as if a second failed payment occurs your access to the Offer will be removed.
If The Client's payment fails after two attempts this will be considered a cancellation of The Client's membership. If you wish to rejoin, you can at the current, future investment for the Offer ie. you will not receive your initial if the current investment at time of rejoining has changed.
Cancellation
The client may wish to terminate the agreement via email to jin@theartoflisteningtoyourbody at least 7 days BEFORE a renewal period. It is the Client's responsibility to know when this is. Please note that you will receive confirmation of cancellation within 48 hours. If not please follow up. This will cancel the auto-renewal however you will have continued access for the period you have invested in.
Refund & Transfer Policy
To save you and me time, before you invest in yourself make sure you feel into your heart and trust that you are making a decision that is good for you now and for your future.
All sales of the offer are final and non-refundable.
There are no refunds offered on live offers, prerecorded digital material, or memberships.
Digital products where you receive instant access and the material can be consumed quickly.
We do not offer refunds in this case and this is clearly stated on the checkout page.
Any payments for this Program are non-transferable.
Intellectual property
All intellectual property and interests owned or used by the Company shall remain owned exclusively by the Company. The Client will not share, use or profit from any of the material provided to them by the Company, (or acquired from others in a group session (if applicable)
Intellectual Property includes (but is not limited to):
Designs, know how experience, course materials, brochures and methods; and
Any intellectual property which is created as a result of, or in connection with the provision of Services by the Company to you.
Confidentiality
The Company values the integrity of the Program and it is essential that The Client agrees not to disclose, communicate to or place at the disposal to any third party any information obtained from the online platform in any form or by any means and keep the information in the strictest confidence.
The Company and the Client shall keep confidential and make no disclosure of any information obtained by either party during the service (this includes any information disclosed by others during a group session or coaching call), except where.
Disclosure is required by law;
The information has become public knowledge
Disclosure is required to a lawyer or accountant of either party or a bona fide financier or potential purchaser of the Company’s business
The Client agrees that the Company may use information (including video recordings, audio recording, photographs, interviews and statements) for learning purposes, and makes them available to other participants for learning purposes.
Disclaimer and Limit on Liability
The Company does not guarantee results or future earnings. The Client agrees that the Company is not liable or responsible for adverse reactions as a result of the advice given.
The Company does not provide treatment for any medical conditions, professional health advice, legal, tax or financial advice.
The Company will try ensure that any descriptions of the design or contract of services is as informative as possible by it is for the Client to take responsibility for deciding whether or not a programme is suitable for their needs.
The Company shall not be liable to the Client for any loss of profits or any consequential, indirect or special loss or damages suffered by the Client arising directly or indirectly from any breach by the Company of this agreement or from any negligence or other act or omission of the Company.
You alone are responsible and accountable for your decisions, actions and results in life, and by your registration here you agree not to attempt to hold us liable for your decisions, actions or results, at any time, under any circumstance.
Indemnity
The Client indemnifies the Company for any losses, costs, claims or demands suffered by the Client that directly results from the Client’s participation or actions under this agreement.
Termination
In addition to the cancellation and refund policies already outlined in this agreement, the Company reserves the right to serve you with 10 working days’ notice of its intention to terminate this agreement for breach of this agreement including;
Default through lack of payment
Lack of adherence by the Client to the Guidelines provided
Disclosure of confidential information to 3rd parties
Change to Terms
We reserve the right to update, change or replace any of these Terms of Service. We will endeavour to notify you of these changes. It will be the responsibility of the Client to review the notification and changes
