This agreement is entered into between The Art Of Listening To Your Body Limited (The Company) and You (The Client).
The Moth Portal (Offer).
Mini-courses and masterclasses (Program(s)).
Services
The Client will be provided access to pre-recorded Programs.
Whilst a member The Client will also receive offers via email to join any live elements (ie present on zoom for the teaching or access live Q&A) offered alongside future Programs which will be added to the Offer.
Programs are hosted on the Kajabi platform. The Client will be given access to the Offer and all Programs within this offer as long as your membership remains active.
At times mini-courses and masterclasses may be updated or removed if they are no longer aligned with the Company's ethos.
*Excludes signature live coaching Programs such as Release, Emotional Body Training and any other ongoing group coaching offers and/or masterminds as well as 1:1 offers.
Fees
Monthly membership.
As a founder the fee for access to the Offer is $111 USD/month as long as you stay an active member your investment will not change for 12 months after which you will be asked if you would like to renew access to the Moth Portal at the current investment.
For members that are not founders the investment for the Offer will be increasing to at least $222 USD/month and continue to increase as more Programs are added over time. The monthly investment will remain the same for a 12 month period from time of investing in the Offer
Payment
Monthly memberships are direct debited from The Client's provided credit card each month.
Payment is required in full to gain access to the Offer. The Client agrees to pay in full the amount due for their chosen period of investment. The Client authorises the Company to charge the card provided on a monthly basis.
The Client is responsible to ensure that payments go through smoothly on time, without delay. Any failed our bounced payments are followed up with an email from out system which allows time to ensure your credit card details are up to date. Our system will automatically retry taking payment. Please action this promptly as if a second failed payment occurs your access to the Offer will be removed.
If The Client's payment fails after two attempts this will be considered a cancellation of The Client's membership. As a founder if you wish to rejoin, you can at the current, future investment for the Offer ie. you will not receive your founder's rate if there is no continuation of your membership.
Cancellation of your membership
The Client is able to cancel their membership for this Offer at any time giving at least 30 days notice before the next renewal period.
After cancellation The Client will no longer have access to any of the Programs.
The Client is more than welcome to rejoin again in the future if they wish at whatever the current investment may be at the time.
Refund & Transfer Policy
To save you and me time, before you invest in yourself make sure you feel into your heart and trust that you are making a decision that is good for you now and for your future.
No refunds will be processed when notification has been given after a renewal period. If a renewal goes through you will be given access for the remainder of that month, and we will ensure that your next payment is cancelled.
Payments for this program are non-transferable.
Confidentiality
Anything shared by you and the Coach on the live group coaching calls and replays is to remain confidential and not to be shared with any parties outside of the Offer.
As part of the Client's participation in the Program the Client agrees that the Company may video record, audio record, photograph or otherwise capture my likeness, voice, images, interviews and statements made and the Client agrees that the Company may use such material and make available to other participants for learning purposes.
The Company values the integrity of the Program and it is essential that all communication remains confidential to those participating in the course.
The Client agrees not to disclose, communicate to or place at the disposal to any third party any information obtained from the online platform in any form or by any means and keep the information in the strictest confidence.
Indemnification
The Client agrees to indemnify and hold harmless the Company, affiliates, and respective directors, agents, contractors, employees from any and all claims, demands, losses, causes of action, damage, lawsuits, judgements, including attorney's fees and costs arising out of, or relating to the Client's participation or action(s) under this agreement. The Client agrees to defend against any and all claims, demands, causes of action, lawsuits, and/or judgements arising out of, or relating to, the Client's participation under this agreement, unless expressly stated otherwise by the Company in writing.
Limitation of Liability
You understand that the Program is not to provide treatment for any medical conditions, nor does it substitute professional advice for any health issues.
The Company shall not be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on the online platform, even if the Program or an authorised of the Program has been notified orally or in writing of the possibility of such damage.

Non-Disclosure Of Company Materials/Intellectual Property Rights
The Client understands that any material provided by the Company is solely for personal use only. The Client is not allowed to share any Company material. The Company's Program material and any other course material shared shall remain the sole property of the Company.
All concepts, information and materials in delivered in the Program are the property of the Company. The Company shall have sole title and ownership of all Intellectual Property Rights in the Materials or Recordings or created in the provision of any of its services. Whereby, “Intellectual Property Rights” means patents, trademarks, copyrights, database rights, design rights, applications for registration of any of the foregoing and all rights of like nature arising or subsisting whether registered or unregistered;
In delivering the Program we do not transfer title to you of any intellectual property and title to all such intellectual property remains with us.
Changes to terms and conditions
We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
